Section 1 General provisions

We process your personal data (e.g. title, name, address, email address, phone number) in accordance with the provisions in German data privacy legislation and European Union (EU) data privacy legislation. In addition to processing purposes, legal grounds, recipients and retention periods, the following regulations also outline your rights and the controller of your data that are processed. This data privacy statement refers exclusively to our website. If you are directed to other pages via links on our pages, please refer to their privacy policies for information on how they handle your data.

Section 2 Contact

(1) Purpose of processing

We use your personal data which you provide in an email, contact form or similar to answer and handle your enquiries. You are not obliged to provide us with your personal data, but we are unable to respond to you by email if you do not give us your email address.

(2) Legal basis

a) If you have expressly given your consent to your data being processed, the legal basis for this processing is Art. 6(1)(a) GDPR.

b) If we process your data to complete pre-contractual procedures, the legal basis for this processing is Art. 6(1)(b) GDPR.

c) The legal basis is Art. 6(1)(f) GDPR in all other cases, in particular when a contact form is used.

RIGHT TO OBJECT: You have the right to object at any time to the processing of data which was performed in accordance with Article 6(1)(f) GDPR and which does not serve direct advertising for reasons arising from your particular situation.

In the case of direct advertising, however, you may object to the processing without stating any reasons at any time.

(3) Legitimate interest

Our legitimate interest in data processing is based on our desire to communicate with you promptly and answer your enquiries in a cost-effective manner. If you provide us with your address, we reserve the right to use it for direct postal advertising. You can safeguard your interest in protecting your data by limiting the data that you share (e.g. using a pseudonym).

Your data will be deleted if circumstances dictate that your enquiry or question has been fully resolved.

However, if a contract is concluded, we will store the data required under commercial and tax legislation for the specific statutory time periods, usually ten years (see Section 257 German Commercial Code [HGB], Section 147 German Fiscal Code [AO]).

Section 3 Website analysis with Google Analytics

(1) Purpose of processing

This website uses Google Analytics 4, a website analysis service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). Google Analytics 4 uses what are known as “cookies”, i.e. text files which are saved to your terminal device and used to analyse your use of the website. Google states that no individual IP addresses are recorded or stored with Google Analytics 4. No precise location data are provided in Analytics. The following IP address metadata are recorded instead: “City” (and the city’s latitude and longitude), “continent”, “country”, “region”, “subcontinent” and their respective ID-based equivalents. If the website is accessed within the EU, IP addresses are only used to determine location data and are then immediately deleted. They are not recorded, they are not accessible and are not used for other use cases. If measurement data are collected in Analytics, all IP searches are made on EU-based servers before the traffic is forwarded to the Analytics servers for processing. These servers are located outside the EU.

Google will use this information to evaluate your use of the website, compiling reports on website activity for the operator of this website and providing other services relating to website activity and internet usage to the website operator.

The legal basis for this processing is your consent as per Art. 6(1)(a) GDPR.

Google Ireland Limited is an associated company of Google LLC. Google LLC is based in the US (1600 Amphitheatre Parkway, Mountain View, CA 94043). The basis for transmitting personal data from the EU to the US is the EU–US Data Privacy Framework.

You can revoke your consent at any time with future effect using our cookie banner or on our website.

You can also prevent cookies from being stored universally by making an appropriate setting in your browser software; however, be advised that you may not be able to make full use all of this website’s functions in such cases.You can also prevent Google from collecting the data generated by the cookie and related to your use of the website (including your IP address) and, subsequently, processing these data by downloading and installing a browser plugin available from the following link: opt-out

Section 4 Information about cookies

(1) Purpose of processing

Cookies required for technical reasons are used on this website. These are small text files which are stored on or by your browser on your computer system.

(2) Legal basis

The legal basis for this processing is Art. 6(1)(f) GDPR.

(3) Legitimate interest

Our legitimate interest is to ensure our website functions correctly. The user data collected by the technically necessary cookies are not used to produce user profiles. This means your data privacy interests are protected.

(4) Period of storage

Technically necessary cookies are usually deleted when the browser is closed. Permanently stored cookies have a varying lifespan, ranging from a few minutes to several years.

(5) RIGHT TO OBJECT

If you do not wish these cookies to be stored, disable their acceptance in your browser. This may limit the functions on our website. You can also delete permanently stored cookies at any time in your browser.

Section 5 Your rights as a data subject

If your personal data are processed, you are regarded as the data subject under the GDPR and you have the following rights in relation to us as the data controller:

1. Right to request access

You can require us to provide information about your personal data that we have processed as per Art. 15 GDPR.

2. Right to rectification

If the information about you is not or no longer accurate, you may require rectification in accordance with Art. 16 GDPR. If your data are incomplete, you may require that they be made complete.

3. Right of erasure

You may demand that your personal data be erased in accordance with the conditions in Art. 17 GDPR.

4. Right to restriction of processing

You are entitled to require us to restrict processing of your personal data as specified in Art. 18 GDPR.

5. Right to data portability

You have the right to require us to supply your personal data which you have provided to us in a structured, commonly used, machine-readable format or to transmit such data to another controller as per Art. 20 GDPR.

6. Right to revoke a declaration of consent related to data privacy

You have the right to revoke your declaration of consent related to data privacy at any time as per Art. 7(3). Withdrawal of consent has no impact on the legality of data processing activity up to the point in time when consent was revoked.

7. Right to lodge a complaint with a supervisory authority

If you believe that the processing of your personal data is in breach of the GDPR, you are entitled to lodge a complaint with a supervisory authority as indicated in Art. 77 GDPR, particularly in the member state where the member state of your habitual residence, place of work or the place of the alleged infringement is located.

Also bear in mind your right to object as per Art. 21 GDPR:

a) General: justified objection necessary

If your personal data are processed

– to safeguard our overriding legitimate interest (legal basis: Art. 6(1)(f) GDPR)

– due to public interest (legal basis: Art. 6(1)(e) GDPR)

you have the right to object at any time due to reasons related to your specific situation; this also applies to profiling based on the provisions in the GDPR.

In the case of an objection, the controller will no longer process your personal data unless the controller demonstrates compelling legitimate grounds for processing which override your interests, rights and freedoms, or processing serves to establish, assert or defend legal claims.

b) Special case of direct advertising: a simple objection is sufficient

If your personal data are processed for direct advertising purposes, you have the right to object to processing of your personal data for such processing at any time and without needing to state the reasons why. This also includes profiling if it is related to such direct advertising.

If you object to processing for direct advertising purposes, your personal data will no longer be processed for such purposes.
